BUILDIT ADMIN SOLUTIONS
Terms, Privacy and Data Use
1. About BUILDIT and these terms
BUILDIT Admin Solutions operates a construction capability and professional development platform, including Professional Profiles, assessment pathways, practical scenarios, development resources, Company Profiles, organisational intelligence, Trophy Markers, specialist pathways, implementation support and related services.
These Terms, Privacy and Data Use provisions apply to visitors, registered professionals, company administrators and organisations using BUILDIT. They form part of the agreement governing access to the website and member service.
Where the Privacy Act 1988 (Cth), the Australian Privacy Principles or another privacy law applies to BUILDIT or a particular activity, BUILDIT will comply with those legal obligations. Regardless of whether a particular statutory privacy obligation applies in a specific circumstance, BUILDIT agrees to handle personal information consistently with the commitments made in these terms.
2. Eligibility, accounts and access
You must provide information that is accurate to the best of your knowledge and keep account information reasonably current. You are responsible for protecting your login credentials and for activity conducted through your account unless the activity results from a failure within BUILDIT’s systems or security.
Company administrators may invite or associate users with a company, project, team, role family or business unit for legitimate workforce development and organisational purposes. A company association does not transfer ownership of a professional’s private assessment record to that company.
BUILDIT may refuse, suspend or restrict access where reasonably necessary to protect users, data, the platform, another organisation, intellectual property, legal compliance or system security.
3. The Professional Profile
The Professional Profile is designed as an individual development environment. It may contain role history, experience, assessment results, practical scenario responses, feedback, workplace experience, development history, progress, specialist pathways and resources unlocked through participation.
A Professional Profile may continue to be useful across roles, projects and employers. A company that pays for access does not thereby acquire ownership of the user’s private Professional Profile content.
Users may be offered controls that allow selected professional information or summary results to be shared. Unless a sharing control expressly states otherwise, private information remains private.
4. Company Profiles and organisational intelligence
Company Profiles are designed to help participating organisations understand eligible aggregate patterns across capability, commercial awareness, onboarding, development, workflow, decisions, interfaces, operating environment, talent depth and related organisational factors.
Company reporting may use project, discipline, role family, business unit or other cohort groupings. BUILDIT may apply minimum cohort sizes, suppression rules, de-identification techniques or other controls where reasonably necessary to reduce the risk that private individual information can be inferred.
BUILDIT may improve aggregate analysis and pattern recognition as the platform develops. Any material change that would expand employer access to identifiable private assessment information requires an appropriate notice, permission process or other lawful basis before that access is enabled.
5. Assessment privacy and control
Your detailed assessment responses are private. Individual answers, written responses, emotional disclosures, private feedback and detailed assessment history are not routinely made available to employers, recruiters, other members or the public.
5.1 Why assessment information is stored
BUILDIT stores assessment responses, saved progress, results, assessment versions, relevant dates and related development information to operate the assessment, maintain development history, provide requested feedback, support retesting and improve the user’s own development experience.
5.2 Operational access
Authorised BUILDIT personnel and service providers may access or process assessment information only where reasonably necessary to operate, host, maintain, secure, troubleshoot or support the service, comply with law, or perform another use expressly permitted by these terms.
5.3 Optional sharing
If BUILDIT introduces summary sharing, it will be off by default unless a different arrangement is clearly explained and agreed. The user should be able to understand what information will be shown and to whom before confirming a sharing choice.
Selecting a summary for display does not authorise disclosure of underlying answers, written responses, emotional disclosures, private feedback or detailed history unless that information is separately and specifically selected for disclosure.
New assessments and newly calculated results remain private unless an applicable sharing choice, lawful disclosure or other expressly stated arrangement applies.
5.4 Current release
Where the current release does not provide summary sharing controls, assessment results remain private within the member service subject to necessary operational access, legal obligations and the other limited uses stated in these terms.
6. Company, HR and administrator responsibilities
A company or administrator using BUILDIT is responsible for ensuring that its invitations, account administration, use of Company Profile information and employment-related activities comply with applicable workplace, privacy, discrimination, record-keeping and other laws.
Company account holders must not:
- attempt to obtain or reverse engineer private assessment answers from aggregate reporting;
- pressure users to disclose private assessment responses where the platform has kept those responses private;
- misrepresent BUILDIT outputs as medical, psychological, legal or formal employment advice;
- upload sensitive or confidential information about another person unless authorised and reasonably necessary;
- use the platform to discriminate unlawfully, harass, retaliate or make prohibited employment decisions;
- share company-level access credentials with unauthorised persons; or
- use Company Profile outputs outside legitimate organisational, development, workforce planning or project purposes.
Company administrators are responsible for assigning users to the correct organisation, project and cohort where those assignments affect reporting. BUILDIT is not responsible for misleading outputs caused by materially inaccurate company-supplied classifications or unauthorised account administration.
7. Personal information, data use and the no-sale commitment
7.1 What BUILDIT may collect
Depending on the services used, BUILDIT may collect account information, professional and role information, company and project associations, assessment responses, practical scenario responses, progress, learning activity, feedback, support communications, technical logs and other information supplied through the service.
7.2 Primary uses
BUILDIT may use information to:
- provide, maintain, secure and improve the platform;
- operate Professional Profiles and Company Profiles;
- calculate assessment, development and aggregate organisational outputs;
- provide feedback, learning pathways, resources and support requested by users;
- detect misuse, security issues and technical faults;
- administer memberships, company access and payments;
- comply with legal obligations; and
- produce de-identified or appropriately aggregated statistics and service insights.
7.3 BUILDIT will not sell private user data
BUILDIT will not use private assessment responses for targeted advertising. BUILDIT will not provide private assessment information to a recruitment service for candidate screening unless the relevant user has specifically authorised that disclosure.
This no-sale commitment does not prevent BUILDIT from using service providers that process information on BUILDIT’s behalf for hosting, security, communications, support, payments, analytics or other necessary service functions, provided those providers are subject to appropriate contractual, confidentiality and security controls.
It also does not prevent disclosure required by law, court order or a legitimate security or safety response, or disclosure specifically requested or authorised by the user.
7.4 Aggregate and de-identified information
BUILDIT may use and disclose genuinely de-identified or appropriately aggregated information for Company Profile reporting, service improvement, benchmarking, research into construction capability and product development, provided the information is handled so that it is not presented as an identifiable private assessment record.
BUILDIT will take reasonable steps to avoid presenting small cohort outputs in a way that makes private individual responses readily identifiable.
8. AI, automated analysis and scoring
BUILDIT may use automated methods, algorithms or artificial intelligence to assist with scoring, pattern recognition, feedback, content recommendation, summarisation or product functionality.
Where private personal information would be sent to an external AI or automated service provider, BUILDIT will provide an appropriate explanation of the proposed use and apply the permissions, contracts and privacy controls required for that use before information is sent.
BUILDIT does not authorise an employer to treat an automated score, profile label, archetype or AI-generated observation as a definitive statement about a person’s suitability, character, health or future performance.
BUILDIT’s intended use of automated analysis is to support professional development and organisational insight, not to make fully automated hiring, firing, disciplinary or other significant employment decisions on behalf of an employer.
9. Security, service providers and overseas processing
BUILDIT will take reasonable technical and organisational steps appropriate to the nature of the service and information held to protect personal information from misuse, interference, loss and unauthorised access, modification or disclosure.
No internet service can guarantee absolute security. Users and companies must also take reasonable steps to protect account credentials, devices and authorised access.
BUILDIT may use reputable third-party providers for hosting, storage, communications, analytics, security, payments or support. Some providers may process information outside Australia. Where applicable, BUILDIT will take reasonable steps required by Australian privacy law in relation to overseas handling or disclosure and will explain material overseas processing arrangements in the privacy information made available to users.
If BUILDIT becomes aware of an eligible data breach or another breach that requires notification under applicable law, BUILDIT will take the steps required by that law, including notification where required.
10. Access, correction, deletion and retention
Users may request access to or correction of personal information held by BUILDIT. BUILDIT may need to verify identity before responding and may refuse or limit a request where permitted or required by law.
Users may request deletion of assessment or account information. Deletion may remove development history, comparisons, unlocked content, feedback or other functionality that depends on the deleted information.
BUILDIT may retain information where reasonably necessary to provide the service, maintain security and audit integrity, resolve disputes, comply with contractual or legal obligations, maintain backups for a reasonable period or preserve information that must be retained by law.
Where personal information is no longer required for a permitted purpose and no legal retention requirement applies, BUILDIT will take reasonable steps to delete or de-identify it.
11. Intellectual property and user content
BUILDIT owns or licenses the platform, software, designs, assessment structures, scoring methods, manuals, scenarios, frameworks, Trophy Markers, written materials, graphics, branding and other BUILDIT content unless expressly stated otherwise.
Access to BUILDIT gives users a limited, non-exclusive, non-transferable right to use the service and materials for the purposes made available through their account. It does not transfer ownership of BUILDIT intellectual property.
Users retain rights they hold in original information they submit. Users grant BUILDIT a limited licence to host, process, reproduce and use that information only as reasonably necessary to operate the service and for the other permitted purposes described in these terms.
Users must not copy, scrape, reproduce, resell, publish or systematically extract protected BUILDIT materials outside the permissions provided by the service or applicable law.
12. Acceptable use
Users must not use BUILDIT to:
- gain unauthorised access to accounts, data or systems;
- interfere with security, availability or operation of the service;
- upload malicious code or intentionally harmful material;
- impersonate another person or materially falsify account authority;
- harass, threaten or unlawfully discriminate against another person;
- extract private information about another user without authorisation;
- infringe intellectual property, confidentiality or privacy rights; or
- use the platform for unlawful purposes.
13. Free access, paid access and future fees
BUILDIT may offer some services, profiles, assessments, resources or features without charge during development, pilot, introductory or other periods. Free access does not create a right to permanent free access.
BUILDIT may also change prices for future billing periods or future purchases. Before a user or company is charged, the applicable price, billing basis and any recurring payment arrangement will be disclosed through the relevant purchase, subscription or agreement process.
BUILDIT will not retrospectively charge a user for a period that was represented as free and will not initiate a new recurring charge without an agreed payment arrangement.
If a paid plan is introduced for functionality previously available without charge, users may be required to select a paid plan to continue using that functionality after reasonable notice. Where reasonably practicable, BUILDIT may provide options to access, export or manage relevant personal information before paid access takes effect.
Company licences and enterprise arrangements may be governed by additional commercial terms agreed with the company. If those terms conflict with these public terms, the specifically agreed commercial terms apply to that company to the extent of the conflict, except where a legal or privacy commitment expressly states otherwise.
14. Employment, HR and professional decision limitations
BUILDIT is a professional development and organisational intelligence platform. It is not a substitute for professional legal, industrial relations, psychological, medical, financial or human resources advice.
Assessment results, Company Profile metrics, practical scenario scores, archetypes, AI outputs and development indicators may be incomplete, contextual, developmental or affected by exposure, environment and data quality.
BUILDIT does not guarantee that a particular score corresponds to professional accreditation, legal competence, role suitability, promotion readiness or future performance unless a specific product expressly states otherwise.
15. Service availability, pilots and product changes
BUILDIT is an evolving service. Features may be introduced, modified, renamed, replaced, limited or discontinued as the platform develops. Pilot or prototype features may contain incomplete functionality, example data or provisional scoring and should be identified accordingly where relevant.
BUILDIT will take reasonable care in operating the service but does not guarantee uninterrupted or error-free availability. Maintenance, security events, third-party outages, internet failures and other events may affect access.
16. Australian Consumer Law and non-excludable rights
Nothing in these terms excludes, restricts or modifies a consumer guarantee, statutory guarantee or other right that cannot lawfully be excluded, restricted or modified, including rights that may arise under the Australian Consumer Law.
Any disclaimer, limitation or exclusion in these terms applies only to the maximum extent permitted by law.
17. Disclaimers and limitation of liability
To the extent permitted by law, BUILDIT is not liable for a decision made solely by a user, employer, manager, recruiter, adviser or third party based on platform information where BUILDIT did not direct or control that decision.
BUILDIT is not responsible for loss caused by materially inaccurate information supplied by a user or company, unauthorised use of an account outside BUILDIT’s reasonable control, an employer’s unlawful use of outputs, or a third-party service failure outside BUILDIT’s reasonable control, except to the extent BUILDIT is legally responsible for that loss.
Where liability can lawfully be limited, BUILDIT’s liability will be limited to a reasonable amount having regard to the service supplied, the amount paid for the relevant service and the nature of the loss. This clause does not limit liability where doing so would be unlawful.
18. Responsibility for company-supplied information and unlawful use
A company account holder is responsible for ensuring that information it supplies about employees, projects, teams and organisational structures is information it is authorised to provide and use for the stated purpose.
To the extent permitted by law, a company is responsible for losses arising from its own unlawful use of BUILDIT, its unauthorised disclosure of platform information, or a material breach of these terms by its authorised administrators. This does not make the company responsible for failures caused by BUILDIT.
19. Suspension, termination and account closure
A user may stop using BUILDIT at any time, subject to any separately agreed paid subscription or company licence terms.
BUILDIT may suspend or terminate access where reasonably necessary because of non-payment, serious or repeated breach of these terms, misuse, security risk, unlawful activity, infringement, threats to other users or systems, or where BUILDIT is required to do so by law.
Where reasonably practicable and lawful, BUILDIT will provide notice before terminating an account for a remediable breach and allow a reasonable opportunity to address the issue.
Account closure does not automatically remove information that BUILDIT is required or permitted to retain under the retention provisions above.
20. Changes to these terms
BUILDIT may update these terms as the service, law, privacy practices, pricing or functionality changes. The current version will be published on the website with an updated revision date.
If a change materially reduces an existing privacy protection, materially expands employer access to identifiable private information, introduces a new material use of private assessment information, or creates a new recurring payment obligation, BUILDIT will provide an appropriate additional notice or consent process before that change applies where required by law or reasonably necessary for fairness.
21. Governing law
These terms are governed by the laws of Queensland, Australia and applicable Commonwealth laws. Subject to any right that cannot lawfully be restricted, the courts and tribunals with jurisdiction in Queensland may hear disputes relating to these terms.
22. Privacy enquiries, complaints and contact
Questions about these terms, privacy, data handling, account information or the use of BUILDIT should be directed to BUILDIT Admin Solutions.
